Abstract

This article aims to establish that the legal parameters to identify indigenous peoples in Peru limit the application of the self-identification principle. In order to achieve this objective, the international standards on human
rights that enshrine the self-identification as a fundamental criterion are examined. Then, the background of the constitutional and legal terminology to refer to indigenous peoples in Peru is also explained in order to understand why this issue has become a critical one. Finally, as a consequence of the application of the Law of Prior Consultation and considering the extractive context, the
first obstacles that some communities have faced to be considered as indigenous peoples will be discussed.
