Abstract

The article examines the practices of maintaining land rights carried out by small and medium-sized farmers in a valley in central Chile during the first half of the 19th century. In a context of land valorization, the old agreements on the sharing of rights and possession became strained with the advance of ideas and institutions related to full ownership. The research aims to analyze these tensions and the way the actors responded at the intersection of two ownership models. A sample of land disputes and sale deeds was consulted, along with sections of the Chilean Civil Code that regulated the ownership of property. The results indicated that litigants and contracting parties managed the dynamics of both ownership regimes, maintaining the value of use and unfolded ownership in disputes and sale deeds.
